Criminal Appeal Nos. 138 and 139 were instituted by Clemence Mponde1o
and Mapambano Charles respectively. They were slated for hearing on 18.3.2013.
At the commencement of hearing, Ms Farahat Seif, learned State Attorney who
was assisting Ms Rosemary Shio, learned Senior State Attorney both of whom
were representing the respondent Republic, requested us to allow her to submit on
a point of law in terms of rule 4 (2) of the Tanzania Court of Appeal Rules, 2009
