Both applications were brought by Abubakar Ali Hirnid (the applicant) against Edward Nye!usye (1st respondent), Consolidated Ho!d:ng Corporation (2r.rj respondent) and ~'lajembe Auction rv1art (3rd respondent). These appitcetlons share a common background tracing back to the Ruling and Order of the Land Division of the High Court in Land Case No. 42 of 2005 (L.ongway, ].) and later subject of the Civil Appeal No. 70 of 2010 pending in this court.
