H. Mwakyusa dated 31/8/2005. The learned judge struck out the application in response to a preliminary objection taken at the instance of the respondent that a similar.' application (Mise. Civil Application No. 85 of 2006) was withdrawn by the applicant (the appellant herein) without leave to institute a fresh application for the same order.
