EDGAR LITIMBA(App) Vs THE REPUBLIC(Res)The District Court of Songea at Songea convicted the appellant with the offence of rape contrary" to sections 130(1)(2)(a) and 131(a) of the Penal Code, [CAP 16, R.E.2002]. The charge sheet reads that the offence was committed on 2nd August, 2004. The complainant was then aged 16 years. The appellant was sentenced to thirty years imprisonment and twelve stokes of the cane. In addition, he was ordered to pay to the victim of the offence (Jane Ngwala PW1) an amount of Tshs. 500,000/= as compensation, the same to be paid by the parents of the appellant.
