The applicant is seeking for an order that the Notice of Appeal for the intended appeal be struck out with costs on the grounds that the respondents (i) Guardian Limited and (ii) Printa Afrique Limited have failed to serve a copy of the said Notice of Appeal on the applicant within the prescribed time.
