This research titled advertising by advocates in Tanzania mainland: assessment of rule 5 (a) (1) of the professional conduct and etiquette for advocacy of the Tanganyika law society, it contains four chapters. First chapter it included a general introduction of the work, background of the problem, statement of the problem, general and specific objectives were used to guide the testing of hypotheses. From literature review, the study found that various studies concur on Advertisement by Advocates on their legal services. The study used case study research design where Magomeni primary Court was the site of the study. The study was conducted under qualitative approach with a total of thirty-five (35) respondents where 25 were sampled purposely and 10 were sampled randomly and the methods used for data collection in this study are Interview and library source. Analysis of data was done qualitatively and presented thematically. On the basis of the Professional Conduct and Etiquette Rules, Advocate shall not permit the Advocate’s name to appear as so on any advertising material offering goods, other than securities or legal publication, or services other than legal publication or services other than legal services to the public. The findings revealed that, ineffective of laws governing advertisement by advocates is one among the reason for advertising of legal profession by Advocates, but also the Professional Conduct and Etiquette to address advertising. This led to sufferings to both legal experts and laymen which have been increasing due to the number of incidents involving advocates not abiding with the professional standards and ethics of the legal profession. The problem of advertising by Advocates as one among the professional misconduct has not yet been properly addressed. Generally, the study recommends that advertising of legal services by Advocates. It’s the researcher’s expectation that the findings of the report will be of great value to the legal profession as a whole and the society generally. |
