A Compulsory Research Report Submitted to Mzumbe University – Mbeya Campus College in a Partial Fulfillment of the Requirement for the Award of Degree of Bachelor of Law of Mzumbe University.The title which states that employees’ rights in criminal case pending trial tends to deal with all rights which are vested to the employees when they are accuse to have committed offences. So, where there is a trial against the employee then the employer is prohibited to unfairly terminate him from his employment until determination of the case and appeal thereto. Labour laws tend to protect the rights of the employees when they are faced with allegations. This study investigated on the rights of employees in criminal case pending trial. The study applied case study design. The primary data were directly collected from the respondents by using Questionnaires and Interview. Many municipal laws were referred to acquire some information on the study. Writings from different scholars and government documents were also visited for secondary data. The research found that Tanzania has complete piece of legislation that to the large extent provide for the rights of the employees when they are alleged to have committed offences. For instance, an employer is prohibited to unfairly terminate the employee from his employment. Although, it was found that many employers fail to conform with laws as they do not adhere to the principle of innocence. Under this circumstance, they accuse their employees and terminate the same accordingly basing on mere allegations. Where this situation is against the Constitution of the United Republic of Tanzania, 1977specifically under the provision of Article 13(6)(b). With due regard, this study put some recommendations including ensuring that the enacted laws are well enforced and protecting the employees’ rights and workers associations should ensure that education is acquired by both employers and employees on protection of the rights.
