This report critically evaluates the enforcement of the laws relating to cigarette smoking in public places in Tanzania.
This study examines the enforcement of the laws that relate to cigarette
smoking in public places in Tanzania, this is due to the fact that; despite
having the existing law which strictly prohibits cigarette smoking in public
places, but still there is a high breach of this law as it seems people are
smoking freely in public places without being caught, therefore this research
evaluates on the enforcement of these laws that relate to cigarette smoking
in public places in Tanzania.
In the course of this research, interview and observation was used as the
mode of obtaining information in relation to the research questions raised by
the researcher which were; what do the lawmakers intended to protect by
enacting the laws to prohibit smoking in public places, whether the present
laws, regulating the selling of tobacco products and prohibiting smoking in public
places have loopholes that pose some difficulties to its enforcement, And
what is the effect of not complying with these laws and which are the
possible measures to ensure enforceability.
The findings of this research indicate that the is no enforcement of the laws
relating to cigarette smoking in public places in Tanzania, and these
laws have loopholes that make it much difficult to enforce it, nevertheless
majority of the people are not even aware of the law itself.
The study recommends that there should be an amendment of some provisions
to include heavy penalties and punishment for any breach of the law (the
existing law) i.e. Tobacco Products (Regulation) Act, not only that but also
there should be much emphasis on policies and strategies which are
implementable on regulation of cigarette use. |
