Abuse of Power of sanctioning Prosecution, delegation of Powers, abuse of
Discretionary powers, delay of Prosecutions, withdrawal of corruption cases by
Nolle prosequi and Interference with the functions of Prevention and Combating
of Corruption Bureau. The research intends to examine those legal challenges
and to what extent can be solved towards prosecution of corruption cases in
Tanzania.
The research employs primary and secondary means of collecting data from various sources towards examination of the legal challenges facing the Prevention and Combating of Corruption Bureau in prosecuting corruption cases.
It is therefore, recommended that the relationship between Prevention and
Combating of Corruption Bureau and Director of Public Prosecution should be
Taken into consideration in reaching the administration of justice before the court of
Laws and the emphasis should be on resolving the legal challenges through
Amendment of various laws towards prosecuting of corruption as well as on the
Process of obtaining evidence to prove the confiscated proceeds are from
Corrupt transaction.
