This research is based upon the problems of which are encountered by profession medical liability in Tanzania. The research wants to show that professional medical liability based on right to health, which is one of the important rights, recognized by our country under article of 11 of the Constitution of the United Republic of Tanzania [CAP 2].
The research focus on attempts to reveal the historical genesis of the professional medical liability at the level of Tanzania as a country, moreover, to elucidates the significance of the study and its methodologies as well as hypothesis and statement of the problem.
The main objective of the study is to examine professional medical liability in Tanzania on the law and practice, trying to analyze liability of medical practitioners, tort law reforms on professional medical liability, barriers to the claims, as well as powers of the Tanganyika Medical Council (TMC) in professional medical liability in Tanzania.
Further on, the research based on different concepts and the legal framework on the laws and challenges relating to professional medical liability. Mostly considered the threshold of understanding right to sue upon health care providers in Tanzania and things which are associated. Also making analysis to the relevant municipal laws and international instruments which governing the medical profession claims at large and its challenges.
Mostly the research concern much in data presentation, analysis and findings obtained through questionnaire while guided by what has been revealed by the study undertaken to what people understood. The questionnaires that were given to specific persons have played a role in presenting the real situation in respect of what they have understood.
Under the conclusion of the chapter, focus much on the general overview of the study and findings while under recommendations deal with the solution on what should be done in curing the defect or weakness of the laws. |
