The purpose of the study was to establish the situation of the prisoner‟s congestion in
Tanzania mainland, its effects to the inmates but also compliance with international
standards on treatment of prisoners. The problem which became the outcry not only
for inmates but both prisoners and remandees. The study has shown the effects of
prisoner‟s congestion to the inmates such as gross violation of human rights, though
the prison of Tanzania mainland are governed and managed by the different written
domestic laws, international and Regional legal instruments related to the good
treatment of inmates and management of prison.
The study is divided into five chapters the first chapter introduce the research and it
deals with background, statement of the problem and literatures reviews among
others. Chapter two is all about the conceptual framework, in which some concepts
regarding to components of criminal justice have been covered, moreover under
chapter three the research deals with legal and institutional framework. Furthermore,
chapter four of the research deals with the data presentations, data analysis and
findings. To achieve this, the researcher used literature review to collect data which
was acquired through reviewing books, articles and dissertations. The last part of this
study is chapter five which contains brief conclusion as well as recommendations
based on the findings which were obtained as result of data analysis.
The objective of the study was to examine and investigate on causes of congestion of
prison, to explore on the impact of congestion in prison, to give out some solution
which can help to reduce and solve the problem such as court use alternative way of
punishing criminals rather than imprisonment but also some strictly rules on
providing bail should be reduced, examining the criminal justice component in
relation to prisons congestion. The findings of the study has revealed that the
problem of congestion in Tanzania has been caused by failure of some components
of administration of criminal justice like courts and police in performing their duties
effectives. The study also has revealed that the prison system of Tanzania has failed
in achieving its main objective of rehabilitating prisoners. |
