The study examines the Law and Practice Governing Extra Judicial Confession in
Tanzania, The objective of the study was to examine the laws and practice governing the taking of extra judicial confession that is to found out if the law makers are aware of the instructions and the procedure which is supposed to be adhered to in taking the Extra judicial confession and if those laws are observed during the taking of extra judicial confession.
The researcher was based on case study approach in which various ways of collecting data including Interview, Literature review and internet sources on the issue of extra
Judicial confessions were used. During the study it was observed that laws and instructions are very clear but the extra judicial takers as the justice of peace are not aware on the existence of those laws and instructions thus they have not viewed instructions completely, and some of them are know it partially.
Findings of the study revealed that the takers of extra judicial confession are ignorant to the laws and procedures which govern the extra judicial confession which make the extra judicial confession to be taken out of the need of procedures, laws and instruction which lead the suspect to provide their confessions involuntary as the result the confession become retracted.
The study recommends that criminal justice system should introduce educational program through which the takers of extra-judicial confession will be educated and learn on how to take the extra-judicial confession, also to provide the chief justice’s manual to the justice of peace to be aware of the procedures which govern the extra-judicial confession also to provide legal aid for the suspects on their rights during the time of interrogation to the police officer and justice of peace. |
