dc.description A Compulsory Research Report Submitted to Mzumbe University – Mbeya Campus College in Partial/Fulfillment of the Requirements for an Award of the Bachelor in Laws (LLB) Degree of Mzumbe University
dc.description This study was conducted on protection of environment in Tanzania, assessing effectiveness of by-law on protection of nuisance (waste) within Singida Municipality. This research was dominated by research objectives and research questions. The research also includes two forms of collecting data which is primary data and secondary, where by primary data include interview questions and secondary data include library research which investigated the factors, which led to the creation of nuisance in relation to sewage system. The research was conducted on a sample of 40 respondents, both laymen civilian, municipal legal officers and municipal health officers. Singida Municipality is the center of my study on the assessment of by-law on protection of nuisance where by overall objective is to examine the effectiveness of by-law on protection of nuisance (waste) within Singida Municipality and to examine whether the law of nuisance applicable in Tanzania is sufficient to combat the problem whether ignorance of people concerning health hazards can treat a nuisance by enacting strict laws. This research found that by-laws governing the problem of nuisance are not effective in Protection of nuisance within Singida Municipality. The problem of nuisance is very rampant within municipality because these by-laws enacted does not have heavy penalty in terms of punishment and compensation, but also there is no coordination between different sectors responsible for environment, also the residents are not well educated and put aware on environment safety and protection and also inadequate of equipment sufficient for environmental workers. Finally, this research recommends that; the Municipality must make amendments of these by-laws and to educate law enforcers on enforcing these by-laws on protection of waste (nuisance) also society should be educated on importance of living in clean environment.
