Environmental pollution is one of the major serious global problems causing desertification, loss of biodiversity, global warming, eruption of diseases and other catastrophes resulted mainly from irregular human activities over the environment
Human beings, forests, coastal areas, wild animals and other natural resources have
been seriously affected. Various instruments have been adopted from international, regional and at domestic level in combating the said crude oil pollution as
well as to ensure sustainable environment protection.
The objective of this study was to analyze the legal framework on managing and conserving the environment by assessing the efficiency of environmental sanctions on pollution caused by crude oil. It strives to assess and find out whether the provided remedies or sanction are comparable with the actual impact likely to happen from the particular harm on the environment so as to give recommendation for combating environmental pollution. In conducting this study the researcher employed both
doctrinal and non-doctrinal research. In doctrinal research the study
examined various international and regional instruments, in domestic level both
principal and subsidiary laws on environment were examined. With non-doctrinal
research the researcher collected various data from NEMC, Mvomero
District Environmental Management Officers, some residents of Malolo ward at
Kilosa and private advocates. The researcher found out that the principal legislations
and by-laws providing penalties for breach of environmental laws are inadequate as
deterrent mechanism for combating environmental problems caused by crude
oil pollution. As a conclusion the researcher recommends amendment of the environmental laws, increase the amount of sanction so as to trap people’s attention in conserving the environment so that they can avoid crude oil pollution that affect the environment.
