dc.description A Compulsory Research Report Submitted to Mzumbe University - Mbeya Campus College in Partial Fulfillment of the Requirement of the Award of Bachelor of Laws Degree (LL.B) of Mzumbe University
dc.description This study critically assessed on the law relating to children who have been obtained from the adulterer’s association. It specifically discussed on the protection of their rights. Whereas due to the researcher findings it has been observed that protection of these rights of children who have been obtained from the adultery is not effectively protected in terms of the custody of the children to be with their biological father, also not effective on the part of inheritance of the properties which have been left behind by the adulterer father. The Law of the Child Act and the Law of Marriage Act are major laws governing regulation of these children and matters pertaining to adultery, but these law did not specifically consider protection of the rights of a child who has been obtained under the adulterer’s association, Which is still a problem in the society and render these children face some effects and challenges while growing up with a single parents. After the findings, the researcher came up with the conclusion and recommendations that, to cure this problem of children born under adultery from losing their rights from the adulterer father is that there must be a specific law governing protection of these children similar to those contained under the international human rights instruments which essentially treat children equally regardless of their status, also the government to ensure implements its obligation under international human rights instruments guaranteeing and protecting human rights, also the government should deal with the discrimination effectively by ensuring that it must not only enact laws promoting equal rights of all children and challenge all forms of discrimination
