This research aims at evaluating and assessing protection of the best interest of a child in divorce proceedings. In doing so the incumbent researcher went through different legislations, international instruments and case laws in order to get a clear position in protection of the child in divorce proceedings. Having conducted research and got data from respondents, the researcher concludes that the best interest of the child has less protection under the law due to the number of reasons. The main reason is because of the main legislation (Law of Marriage Act) dealing with divorce does not provide it. It is silent and therefore the researcher recommends that the Marriage Act be amended to incorporate the best interest of children in the Law of Marriage Act. |
