dc.description The paper presents how Public procurement Act 2004 and its Reg.2005 is used by MAFC as a means towards improving their procurement operations to reduce risk, total cost of ownership, achieves value for money and improve supply chain performance. The main research objective was to assess the effective use of Public Procurement Act 2004 and its Regulations of 2005 at Ministry of Agriculture/ Food Security and Cooperation (MAFC), a sample of 30 respondents were selected. Data were collected through interview, questionnaires, documentary review and observation. Questionnaires were issued filled and used for data analysis, and the collected data were screened, coded and analyzed quantitatively. Simple statistical packages were used to aid data analysis in terms of frequencies and percentages. The researcher found that MAFC implement public procurement Act of 2004 and its Regulations 2005 in moderate capacity in the procurement process. Some of the factors that accounted to this include lack of funds for training personnel in procurement department and other user department, the study found several challenges that affect the implementation of PPA 2004 and its Regulations. Therefore special efforts are needed especially from the top management to solve the challenges facing in the Ministry by setting aside the funds for training personnel in each department for improving procurement process by using PPA 2004 and its Regulations 2005. The researcher conclude that MAFC is implementing procurement process by using PPA 2004 and its Regulations 2005 moderately.
