Procurement of goods, services and works is a key function in every public
institution. This is because every institution requires goods, services and works to
run its operations. This study aspired to examine social, economic and capacity
limitations that slow down effectual compliance with the Public procurement Act;
No.21 of 2004. It exposes limitations in compliance with the Public Procurement Act
2004 at Tanzania Bureau of Standard (TBS) and subsequently develops possible
solution to existing non-compliance with the rule. The study was conducted at the
Tanzania Bureau of Standard (TBS) Headquarter Morogoro road - Dar es Salaam.
The researcher collected data through interviews, questionnaires and documentary
sources which includes files, books, different reports and past studies on the subject.
View of different scholars and authors were reviewed in chapter two so as to gain an
insight of what actually other people see the Public procurement function and the
barriers affecting compliance with the Public Procurement Act ,2004 towards
performance and its regulations in Public organizations.
The study has established that TBS, like many other procuring entities in Tanzania,
has experienced high level of non-compliance with the Public Procurement Act
No.21 of 2004 before 2010. It was seen that 90% of respondents pointed out the
following as the reasons for non-compliance with the rule and regulation governing
public procurement in Tanzania; poor procurement plan, lack of an appropriate level
of staff, lack of incentive to comply, poor records keeping, lack of compulsory
approval system, poor contract management and interference with functional areas
namely PMU, TB and AO. Coming 2011 TBS has a tremendously increase in
compliance up to the level of 87%. This was as the result of establishment of PMU,
PMU staffed at appropriate level, attendance of seminars and conference, increase in
awareness in PPA and existence of independence of TB, PMU, ET, UD and AO.
The study recommended that, TBS should have continues training to its staff,
expanding sources of rising fund, enhancing motivation and recognition and ensuring
decision making does not affect compliance to the act.
