One of the paramount questions for determination in this appeal is the constitutionality or otherwise, under Articles 19(1) and 29(1) of the Constitution of the United Republic of Tanzania, (Cap 2 R.E. 2002) (the Constitution), which respectively, guarantee the right to freedom of conscience and religion and the protection of fundamental rights and duties, of a Circular issued by the Commissioner for Education , which compelled 127 Secondary and Primary School students, believers of Jehovah's Witnesses, a Christian religious sect, to sing the National Anthem during the school assembly.
