This is a research report submitted in partial fulfilment of the requirements for an award of the bachelor of laws (LLB) degree of the Mzumbe University, Mbeya Campus Collage. The main objective of the research was to assess effectiveness of the laws which governing the criminal investigation by Police force in Tanzania mainland specifically a case study of Singida Municipal. The research was conducted at Singida municipal in Tanzania. The methodology used was a combination of focusing group discussion, interview and documentary review. In which those methods were used to collect data in selected population and through sampling design by random sampling technique. In two groups of people that is, police officers who are responsible in conducting such criminal investigation and others were the criminals who are subjected with criminal offences without being investigated with required procedures. During the research the following was realized especially persons who are suspected with criminal offences are not investigated well as the law governed such position and most of the police officers do not follow the required procedures provided under the position of the law So this report is divided into five chapters whereby the first chapter introduces the study and gives background of the issues in concern under the research study, second chapter in on conceptual framework of the study, third chapter is on legal framework for the effectiveness of the laws which governing the criminal investigation by Police force in Tanzania, the fourth chapter represents and analyses the findings and presentation of data obtained from the field work and the last chapter presents the conclusions and recommendations from the research study. So basing on the findings of the study, this work makes the following recommendation basing on the problem of the study which are as follows Arrest should be made on a reasonable cause only, the Courts should dispose cases more rapidly, the physical conditions and programs of prisons and lock-ups should be improved in terms of health and sanitary and the government should improve funds to the police criminal investigators. |
