A Research Report to be submitted to Mzumbe University – Mbeya Campus College in Partial Fulfillment of Requirements for Award of Bachelor of Laws (LL.B) of Mzumbe University
It is belief of the researcher that once the law has been enacted by the parliament, the Courts of law are duly bound to follow without to depart in any way unless there is justification to do so or if the parliament amend the particular law. The research conducted in relation to the law governing assessors in aiding the High Court of Tanzania in criminal trial or cases, that although the law needs full participation of assessors but when it comes to the trial within trial assessors were asked to retire due to this one among of the objective were to examine the position of law in relation to the aid of assessors. Through findings it seemed that the law are not strict followed.
Thus in order to accomplish the intended objective this research comprises with five chapter, where by chapter one covers the general introduction of research, chapter two involve the conceptual framework in relation to the study, chapter three covers the legal framework of the statement of the problem, whereas chapter four includes the finding which are collected from different respondent that are part and parcel to the study and last chapter Five covers the conclusion and Recommendations by relying on findings adduced in chapter four.
