The findings of the research are about the matters concerning the power of arrest given to a private person in relation to human rights in Tanzania. Despite of various domestic and international instruments that Tanzania has put forward to provide for the protection of rights of accused person but its violation has been the disaster by the private persons who violates such rights by conducting cruelty acts and unnecessary injuries to the accused persons. Under this study the researcher aimed at whether the law protects the rights of the accused people. And in this research the means of data collection based on both the primary data which based on interviews and questionnaires while the secondary data based on the documentary review. But also, the findings and recommendations of this report was that there should be enforcement of the laws regulating arrest matter by private persons against violation of the human rights. And how the accused persons are to be treated in a manner that can not violate their Human rights. Because they are not subjected to the unfair treatment and cruelty acts because of what they have committed but also the laws should be emphasized so as to void such cruelty acts to the accused person of which may lead to the violation of their rights as human. More so the recommendations of this report were that to look forward on how to cure the problem by putting effective measures and rules that may guide the private persons’ or the individuals who are given power to conduct an arrest to the accused persons. And there should be a punishment for however violates other persons rights because all people are equal before the law and they are all subjected to equal rights. And the law should be emphasized be implemented to those who are given the power and the right to do and not otherwise.
