The report is based on The Duty to Report a Crime: Analysis of the Law and Practice in Tanzania. Generally everyone in the community have the duty to report crime in the authority authorized to and to police officer in charge of any commission of offenses or likely of the crime to be committed so as to render justice and keep peace and harmony to the community at large as per section 7(1) (a) of the Criminal Procedure Act, but despite the set of the duty by the Law to every person who has hints to provide on the information still mostly are not adhered to such duty rather the breach of it especially the petty offenses like abusive language, affray to mention a few, then what are the causes made the duty to be breached and what to be done to the whole system of the duty to report crime. Therefore, the work is divided into four chapters.
First chapter, is about general introduction, background to the problem, statement of the problem, Literature review discussed on the matter, objectives of the study that are general objective and specific objectives, research hypothesis, significance of the study, as well as the research methodology employed that are research design, target population, methods of data collection that are documentary review, questionnaire and interview.
While in chapter two, is based on the conceptual frame work such as crime, mens rea and actus reus and the legal frame work based on the topic such as the Constitution of the United Republic of Tanzania, Penal Code, Criminal Procedure Act to mention a few.
Chapter three discusses the research findings and the data analysis of the research, discuss on the factors for failure to report crimes in Tanzania, that are believing the crime are trivial to report, family or public interest, fear, traditional belief, tolerance, familiarity with the accused.
Lastly is chapter four, based on the conclusion the summary of the work generally on the findings as well the recommendations made after the observation of the findings and the whole work. |
