The study aimed at investigating the right to compulsory of health insurance service to no-employees in Tanzania. In the statement of the problem explained that right to compulsory if health insurance service in Tanzania is discriminative between employees and non-employees on getting services, in other hand it violates the principle of fundamental right as it provided under the Constitution of United Republic of Tanzania 1977 under Article 14. The objective of study had general and specific whereby general objective is to examine on National Insurance Act on the compulsory health insurance services to the non-employees in Tanzania, and specific objectives is to make a legal analysis on the laws concerning health insurance systems in Tanzania and to examine the principles of equality and right to life in relation to compulsory health insurance services to non-employees in Tanzania.
The researcher manages to use both primary and secondary data whereas primary data a was obtained through questionnaire and interviews. That a researcher uses specific sampling whereby selection was made from relevant hospitals both private hospital and government hospital like Mawezi Hospital and KCMC Hospital, NHIF office a non-employee. While basing on random sampling selection was made to persons who are non-employees depending on the nature of the respondents found. Then the secondary data was obtained through documentary review and online materials.
The findings of the study revealed that laws are not sufficient, are inadequate and discriminative on issue of health insurance service to non-employees. Therefore, based on the findings a researcher recommended that Insurance Act of 2009, the Constitution of United Republic of Tanzania of 1977 together with the draft Constitution of 2014, National Health Insurance Fund Act and Regulation Authority of Health Insurance of 2009 all these should be amended. Again, the government should form different foundations for health insurance service. |
