A Compulsory Research Report Submitted to Mzumbe University – Mbeya Campus College in Partial Fulfillment of the Requirements for the Award of Bachelor Degree of Laws (L.L.B) of Mzumbe University
The research is based on the Analysis of the Law relating to Ceiling on the right to occupy land in agricultural sector in Tanzania. Where, under this study the researcher aimed to examine the laws affecting the ceiling of right of occupancy, whereby the land law has been declared the ceiling of the single right of occupancy and does not provide for the ceiling which covers the whole country, which leading to an unequal distribution of land.
The researcher had the following objectives to examine the suitableness of law relating to the ceiling of the right of occupancy in Tanzania mainland particularly in the agricultural sector and to assess the administration structure of authorities dealing with land management in the ceiling of the right of occupancy. The researcher also used the interview and questionnaire as the methods of data collection whereby the researcher conducted it in Mufindi District- Mafinga Urban for the representation of other areas within the country especially to those regions and areas depends more in sector of agriculture as their earning.
On which the researcher found that the law does not provide for the ceiling of the whole country hence there is no equal distribution of land among the citizens in Tanzania and the person in those authorities given power to set ceiling are much contributing ineffectiveness of the laws governing the ceiling of right of occupancy especially in agriculture sector in Tanzania. The researcher recommended that the laws should amended to the effect that, they should set the ceiling which cover the whole country and not a single right of occupancy and the authority should act according to the way law provides. Since in some areas of our country people depends on agriculture as their only one earning sector.
