A Compulsory Research Report Submitted to Mzumbe University – Mbeya Campus College in Partial Fulfillment of the Requirements for Award of Bachelor Degree of Laws (LL.B) of Mzumbe University
The work is titled “analysis of the Law on attachment and sale in Tanzania”. This research work presents on how the law governing attachment and sale in Tanzania and to what extent it is implemented. It was conducted in Temeke District Court a case study.
The objectives of this research were; to. Whereby collection of data was done through primary and secondary methods.
Findings show that, laws are insufficient on implementation because of a specific provision which restrain attachment and sale properties to the decree holder against the judgment debtor are contrary with other laws, and to some extent people are illiteracy about such law.
In concluding this work, to ensure administration of justice and proper property to be attached and sale are only those be allowed and not otherwise
Although this restrain does not recognized under the Constitution of The United Republic of Tanzania but still is the right to the judgment debtor from shameless in the society and to protect family as an institution.
It recommends that should laws governing attachment and sale should be implement without any obstacle, especially for those law which allow attachment for those property which under agreement. So those to declare all agreement are illegal.
