This research examines the law and practices on the Data Protection and SIM card registration in Tanzania as provided for in the Electronic and Postal Communication Act together with the Electronic and Postal Communication Act (Regulations) and the Electronic and Postal Communication Act (consumer protection) which came with the need of having a well and trust worth method of ensuring that the SIM card users register their SIM cards and also the Registrars register the Sim card users in accordance to the requirement of the law the main concern being the issue of data protection of the individuals on SIM card. The Constitution of the United Republic of Tanzania of 1977 provides for the right to privacy which is a fundamental human right of which ought to be protected and furthermore the development in the telecommunication industry and basically on the mobile phone industry has brought about several outcomes some being positive and other being negative all together associated with the collection of individual data which is then used for several purposes some being the source of infringing the right of having data protected to an individual. In connection to the legal problem, the study has traced back the source of the problem through the background of the problem to come up with the statement of the problem which revealed some aspects which brought about the desire to conduct this research. The research employed qualitative method of data collection which entails the primary and secondary methods of data collection. The research also went further on defining the key terms used in the research providing for some insight on their actual meaning and how they have been used in the research in general. Also, the research has also provided for the legal instruments which have been of help in ensuring that the required amount of information is gathered from the international sphere to the local sphere whereas both Have been helpful in providing the given results. As looking on the law and practice being the key aspect of the study various data which had been gathered has made it possible for the research to come up with a conclusion on the all issue of SIM card registration together with the protection of the data thereto through which the research has been able to make some remarks on the research topic which is Examination of the Laws and Practice, Data Protection and SIM card Registration. |
