The essence of this research focuses on the examination and analysis of the law relating to prohibition of smoking in public place in Tanzania mainland. This study touches various aspects it touches areas in examining the challenges in practical of the law and the shortcoming of the law. The research had objectives and questions in making the study a success. The study contains two categories of objectives that are general and specific. The core objective of the study aimed at making a critical analysis on the need and importance of enacting the Law regulating cigarette smoking and production in Tanzania. Despite the major objective the study also focuses on examining the effectiveness of the law of Tobacco Products in addressing prohibition of smoking in public place also to explore the challenges facing law enforcers on prohibiting smoking in public places. Through the data analysis, the data collected reveals that The Tobacco product (Regulation) Act, 2003 the law regulating smoking conducts is effective but there are number of challenges that face it as an issue of environment and health conduct. Through there commendation given by the researcher the government has the obligation to sensitize and educate the law enforcement agencies, also the government should understand that personal right to live must be taken with serious protection, since it is a basic of all other rights and there for an education should be inflicted to citizens on the observation of the basic right stipulated under article 14 of the constitution of united republic of Tanzania which has an implied connection to this study .
