This research aims at evaluating and assessing protection of the best interest of a child in divorce proceedings. In doing so the incumbent researcher did her best to go through different legislations, international instruments and case laws in order to get a clear position on protection of the child in divorce proceedings. The researcher went on detailed discussion by stating the statement of the problem hence with objectives and research methodology. Having conducted a research and get a way to canvased with respondents up to this particular juncture the researcher concludes that the best interest of the child has less protection under the law due to the number of reasons among others. The main reason is because of the main legislation (Law of Marriage Act) dealing with divorce does not provide it and is silent on how to best provide the interest of children in divorce proceeding. Therefore the researcher recommends that the law/Marriage Act should be amended to protect the best interest of children in divorce proceeding. |
