This study makes an examination on effectiveness of legal framework in facilitating the process of ensuring orderly and planned development of settlement in urban areas. The urban areas settlement development in Tanzania Mainland are governed or regulated by various legislations or laws both principal legislation and subsidiary legislation includes Land Act of 1999 (Cap.113 R.E. 2019), Land Acquisition Act [Cap.118 R.E 2002], Urban Planning Act No.8 of 2007 and Local Government (Urban Authority) Act of 1982 [Cap.288, R. E 2019]. These laws also are implemented by the planning authorities, the central government authority and the local government authority and special agency or authorities like Capital Development Authority (CDA) for planning and design of capital cities. However, urban areas experience growth of unplanned settlement. The study also examines effectiveness of planning institutions in implementing the planning laws and standard for elimination of urban areas informal settlement in Tanzania Mainland.
The study concludes that legal framework that regulates or governs control and management of urban land face challenges in ensuring orderly and coordinated implementation of land use and planning, for elimination of increased urban areas informal settlement. Further, the authorities responsible for implementation of the laws that regulate urban planning have to enforce regulations and standards to improve urban planning in Tanzania. |
