FUTURE CENTURY lIMITED( App) Vs TAN ESCO(Res)The National Service Construction Department (NSCD) was contracted to build 25 blocks of eight apartments for residential occupation by employees of the President's office at Kijitonyama Makumbusho area. The NSCDalso contracted the appellant to supply, install, test and commission power supply to the blocks (Exhibit P.l). The respondent's obligation, as it has always been" was to supply and distribute electricity into the blocks. The appellant did the work.
